1. Acceptance of Terms
By accessing or using the FUNDPLAYGO!platform (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all users including competitors, fans, donors, and sponsors.
2. Description of Service
FUNDPLAYGO!LLC ("Company," "we," "us") operates a competitive sports fundraising marketplace that enables registered competitors to raise funds through tournament-style competitions. The Platform facilitates donations from fans and donors to competitors, and provides advertising and sponsorship opportunities for sponsors.
3. Eligibility
You must be at least 18 years of age to register an account. Competitors registering on behalf of a minor athlete or youth team must be the legal guardian or authorized representative of that organization. By creating an account, you represent that all information provided is accurate and complete.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misrepresent the nature of a fundraising campaign.
5. Fundraising Campaigns
Competitors are solely responsible for the accuracy of their campaign descriptions, use of funds raised, and compliance with applicable laws. FUNDPLAYGO! does not guarantee that fundraising goals will be met. All funds raised, net of applicable fees, are disbursed to the competitor via their registered payout method. Competitors represent that their campaigns are for legitimate sports-related purposes.
6. Donations
All donations made through the Platform are final and non-refundable unless a campaign is determined to be fraudulent. Donors acknowledge they are making voluntary contributions and have no expectation of a return on their donation. FUNDPLAYGO! is not responsible for how competitors use donated funds.
7. Fees and Payments
Payment processing is handled by Stripe, Inc. FUNDPLAYGO! charges a platform service fee on each transaction, disclosed at the time of donation. Sponsors are charged according to their selected ad placement tier. All fees are non-refundable. Chargebacks initiated without valid basis may result in account suspension.
8. Sponsorships and Advertising
Sponsors purchase ad placements in connection with specific tournaments, matches, or rivalries. Sponsor content must comply with our Advertising Standards. We reserve the right to reject or remove any sponsor content that is misleading, offensive, or inconsistent with the FUNDPLAYGO! brand. Sponsor fees are non-refundable once a campaign has launched.
9. Intellectual Property
All content on the Platform, including the FUNDPLAYGO! name, logo, Hype Engine, and platform design, is the intellectual property of FUNDPLAYGO! LLC and protected by applicable copyright, trademark, and patent laws. Users may not reproduce, distribute, or create derivative works without prior written consent.
10. NIL Compliance
Competitors who are student athletes must ensure that participation complies with all applicable Name, Image, and Likeness (NIL) rules at their institution and governing athletic body. FUNDPLAYGO!provides general guidance but is not responsible for individual NIL compliance determinations. Consult your institution's compliance office before registering.
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy, incorporated herein by reference. By using the Platform, you consent to the collection and processing of your information as described in the Privacy Policy.
12. Prohibited Conduct
You agree not to: (a) use the Platform for any unlawful purpose; (b) create fraudulent campaigns or misrepresent your identity; (c) manipulate donations or hype scores through artificial means; (d) interfere with the Platform's technical infrastructure; or (e) violate the rights of any third party. Violations may result in immediate account termination and referral to appropriate authorities.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDPLAYGO! LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
14. Dispute Resolution
Any dispute arising from these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of [State], and judgment on the award may be entered in any court of competent jurisdiction. You waive any right to a jury trial or to participate in a class action.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
